These events and associated ticket sales are organised and operated by Frankieworks (hereinafter: the “Organiser”). The Organiser is solely responsible for the planning, production and execution of each event.

2. Scope of Application
These Terms and Conditions (hereinafter: the “Terms”) govern all tickets sold or distributed by the Organiser, including:
- online purchases made via the Organiser’s website or authorised digital platforms
- on-site purchases made at event venues or physical points of sale.
By purchasing a ticket, the Customer is deemed to have accepted these Terms in their entirety. The applicability of any general terms and conditions of the Customer is expressly rejected pursuant to Article 6:225 of the Dutch Civil Code.
3. Offer and Formation of Agreement
All offers made by the Organiser are non-binding, unless expressly stated otherwise. A purchase agreement is concluded:
- during online sales, at the moment at which payment has been successfully completed and a confirmation has been issued by the Organiser;
- during on-site sales, at the moment at which payment is made and the ticket is issued.
The Organiser reserves the right to refuse or cancel orders in cases of suspected fraud, misuse or manifest error.
4. Prices & Payment
All prices are stated in EUR and include value added tax (VAT), unless expressly stated otherwise. Prices may differ between online pre-sale and on-site sale.
Payment shall be made immediately: online by means of such electronic payment methods as the Organiser makes available, and on-site by card or cash as available. The Customer warrants that the payment method used is lawful and duly authorised.
A chargeback initiated without valid cause shall render the corresponding ticket immediately void, without prejudice to the Organiser’s right to recover the costs reasonably incurred, including extrajudicial collection costs in accordance with the Dutch Besluit vergoeding voor buitengerechtelijke incassokosten.
5. Delivery of Tickets
Tickets purchased online shall be delivered electronically by email or download. Tickets purchased on-site shall be delivered physically or digitally at the venue.
The Customer is responsible for the safekeeping of the ticket. Only the first scan of the unique code on the ticket shall grant admission. Lost, stolen or copied tickets shall not be replaced.
6. Statutory Right of Withdrawal
Pursuant to Article 6:230p, subsection (e), of the Dutch Civil Code, the statutory fourteen-day cooling-off period does not apply to agreements for services relating to leisure activities that are tied to a specific date or period of performance. Accordingly, event tickets are excluded from the right of withdrawal.
Tickets purchased on-site fall outside the rules governing distance sales and likewise carry no right of withdrawal.
7. Refund & Cancellation Policy
All ticket sales, whether online or on-site, are final and non-refundable, save as expressly provided in this Article.
7.1 Full Cancellation of the Event
The face value of the ticket shall be refunded. Service or booking fees charged by third-party ticketing platforms are not refundable insofar as this is lawful. The Customer’s mandatory consumer rights shall remain unaffected.
Tickets shall remain valid for the rescheduled date. Where the Customer is unable to attend the rescheduled date, a refund of the face value may be offered at the Organiser’s discretion, upon timely request.
Line-ups and performers are subject to change without prior notice. Such changes shall not, of themselves, entitle the Customer to a refund.
Refunds, where applicable, shall be processed within fourteen (14) days, by way of the original payment method where reasonably possible.
The Organiser reserves the right to modify the particulars of an event, including venue, timing and line-up, and to cancel or postpone events. Events shall take place irrespective of weather conditions, save where safety considerations require cancellation. The Customer shall be informed by means of the communication channels reasonably available to the Organiser, including the email address provided at the time of purchase.
9. Entry Conditions
A valid ticket shall be presented for admission. Tickets are valid for single use only. Certain events are subject to age restrictions; valid photographic identification may be required at the point of entry, and admission may be refused in the absence thereof.
The Organiser reserves the right, at its sole discretion, to refuse admission or to remove attendees on grounds of intoxication, inappropriate conduct, safety considerations or failure to comply with the house rules, in which case no refund shall be due. Re-entry and late entry are not guaranteed, unless expressly stated.
By entering the venue, the Attendee unconditionally accepts the house rules of the venue and of the Organiser. Without limitation, the following are prohibited on site:
narcotics and any substances unlawful under Dutch law;
weapons and objects of a dangerous nature;
food and beverages not purchased on site, save where expressly permitted;
professional photographic, audio or video recording equipment, absent prior written consent;
promotional, commercial or political materials, absent prior written consent.
The Organiser is entitled to conduct bag and body searches at the point of entry; refusal to submit to such searches constitutes valid grounds for refusal of admission. Prohibited items may be confiscated or denied access, without any obligation on the part of the Organiser to take them into safekeeping.
The minimum age applicable to each event shall be stated on the corresponding event page. Where an event is designated “18+”, persons under the age of eighteen shall be refused admission, irrespective of accompaniment.
In accordance with Article 20 of the Dutch Alcoholwet, alcoholic beverages shall not be sold or served to persons under the age of eighteen. The Organiser and its personnel are entitled at all times to require production of valid proof of age. The provision of alcoholic beverages by an Attendee to a minor on the premises shall constitute a material breach of these Terms and grounds for immediate removal, without any entitlement to refund.
Attendance at the event takes place at the Attendee’s own risk, in particular with regard to:
elevated sound levels which may cause hearing impairment, in respect of which the use of hearing protection is recommended;
the use of stroboscopic lighting, lasers, smoke and other visual effects, which may affect persons suffering from photosensitive epilepsy or comparable medical conditions;
physical exertion in densely occupied spaces.
Attendees are advised to refrain from attendance where their state of health so requires. The foregoing shall not operate to exclude any liability of the Organiser for death or personal injury caused by its intent or gross negligence.
The Attendee acknowledges that photographic, film and audio recordings may be made at the event and consents to the use of such recordings by the Organiser for promotional, editorial and archival purposes, including publication on social media, the Organiser’s website and aftermovies.
The legal basis for such processing is the legitimate interest of the Organiser in the promotion of its events within the meaning of Article 6(1)(f) of the General Data Protection Regulation, having regard to the reasonable expectations of Attendees and to the notice given in these Terms and at the venue.
An Attendee who does not wish to be identifiable in such materials may notify the Organiser at the contact address specified in Article 1. The Organiser shall take reasonable steps, within the bounds of technical feasibility, to obscure or remove the relevant images.
Insofar as a cloakroom service is made available, items are left therein at the Attendee’s own risk. The Organiser’s liability for loss of or damage to items deposited in the cloakroom is limited to a maximum of one hundred euros (EUR 100) per Attendee, save in the event of intent or gross negligence on the part of the Organiser.
Attendees are strongly advised not to bring valuables onto the premises. Items found on site shall be retained for a maximum period of four (4) weeks and may be reclaimed via the contact address specified in Article 1.
Tickets are issued for personal use and may not be resold for commercial purposes without the prior written consent of the Organiser. Resale is permitted exclusively through authorised resale platforms, such as TicketSwap, subject to the following conditions:
the original ticket holder shall remain responsible for ensuring the correct transfer of the ticket;
the Organiser is not responsible for tickets purchased through unauthorised third parties.
Tickets obtained through unauthorised channels, or resold in breach of these Terms, may be invalidated without refund or refused at entry. The Organiser reserves the right to cancel any ticket resold in breach of these Terms.
The liability of the Organiser is limited to the extent permitted by Dutch law. Liability for direct damages is limited to the face value of the ticket. The Organiser shall not be liable for indirect or consequential damages, including, without limitation, travel costs, accommodation costs and loss of income.
The foregoing limitations shall not apply:
in cases of intent or gross negligence on the part of the Organiser or its management;
in cases of death or personal injury caused by the negligence of the Organiser;
where mandatory consumer protection provisions under Dutch or European Union law provide otherwise.
The Organiser shall not be liable for any failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to government restrictions, public health emergencies, natural disasters, extreme weather, strikes and labour disputes, failures of power, telecommunications or payment systems, terrorism, war or civil unrest.
In the event of force majeure exceeding sixty (60) days, either party shall be entitled to terminate the agreement, without any right to damages.
The Organiser, acting as controller, processes personal data in accordance with the General Data Protection Regulation (“GDPR”). The categories of data processed are identification and contact data, payment and transaction data, ticketing data, and image and recording data as referred to in Article 13.
Personal data are processed for the following purposes and on the following legal bases:
order processing and ticket delivery — performance of contract (Article 6(1)(b) GDPR);
customer communication — performance of contract and legitimate interest;
compliance with legal obligations, including invoicing and taxation — legal obligation (Article 6(1)(c) GDPR);
marketing, where consent has been given — consent (Article 6(1)(a) GDPR), which consent may be withdrawn at any time.
Personal data may be shared with the Organiser’s payment service provider, ticketing platform and IT and hosting providers, in each case bound by appropriate safeguards. Personal data shall be retained no longer than necessary and, in any event, not beyond the statutory retention periods, including the fiscal retention obligation of seven (7) years.
The data subject is entitled to exercise the rights of access, rectification, erasure, restriction, portability and objection, and to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens, autoriteitpersoonsgegevens.nl). Transfers to countries outside the European Economic Area shall take place only on the basis of appropriate safeguards within the meaning of the GDPR.
The Organiser endeavours to render its events accessible. Attendees with a disability or chronic illness requiring specific accommodations are invited to contact the Organiser at least seven (7) days prior to the event, via the contact address specified in Article 1, in order that a joint assessment may be made as to what is reasonably practicable. This policy is pursued in conformity with the Dutch Wet gelijke behandeling op grond van handicap of chronische ziekte.
Complaints shall be submitted by email to the contact address specified in Article 1 within a reasonable period after the Attendee has become aware of the matter complained of, and in any event within two (2) months. The Organiser shall endeavour to respond within fourteen (14) days.
Consumers may, where applicable, also submit the dispute to the competent Dutch court in accordance with Article 22.
Nothing in these Terms shall operate to limit or exclude any mandatory consumer rights afforded by Dutch or European Union law.
Should any provision of these Terms be held to be void, voidable or otherwise unenforceable, in whole or in part, the remaining provisions shall continue in full force and effect. The provision thus affected shall be deemed replaced by a valid provision that approximates, as closely as possible, the content and purpose of the original, in accordance with the conversion rule set out in Article 3:42 of the Dutch Civil Code.
These Terms shall be governed by and construed in accordance with the laws of the Netherlands. All disputes arising out of or in connection with these Terms or any event shall be submitted exclusively to the competent court of the district of Midden-Nederland, Utrecht, without prejudice to the mandatory rules of consumer jurisdiction entitling consumers to bring proceedings before the court of their place of residence.
The Organiser may amend these Terms at any time. The most recent version shall at all times be available on request and on the Organiser’s website.
